New smoking regulations come into force at 6am
on July 1, 2007. From that date, we understand it will be
illegal to smoke in most indoor public places including, for the
most part, care homes.
The law will also apply to work vehicles
unless the vehicle is used primarily for the private purposes of a
person who owns it, or has a right to use it which is not
restricted to a particular journey.
Designated smoking rooms in care homes with
long-term residential accommodation are allowed and are exempt
under the legislation. They can be used by residents and their
guests only - and not by employees.
Designated rooms must be completely enclosed;
fitted with a ventilation system that does not vent into any other
part of the care home premises; have a door that is mechanically
closed automatically after use; and must be clearly marked as a
room in which smoking is permitted.
The employer is advised to develop and
implement a written smoke-free policy with staff to ensure
infringements of the law are dealt with under agreed disciplinary
procedures.
The employer must also display formal 'no
smoking' signs in prominent positions at each public entrance to
the premises and these should be at least equal to A5
size.
